By accessing or using CloseEngine AI's services ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Section 02

Description of Service

CloseEngine AI provides an AI-powered lead calling and follow-up service for licensed real estate agents. Our AI assistant calls and follows up with your leads on your behalf using automated voice and SMS technology.

Section 03

Eligibility

You must be a licensed real estate agent or authorized representative of a real estate brokerage to use the Service. You must be at least 18 years of age.

Section 04

Account and Registration

You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Section 05

Acceptable Use

You agree to:

• Provide only leads who have given consent to be contacted.
• Comply with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA) and state-specific telemarketing and two-party consent laws.
• Not use the Service for any unlawful, harassing, or fraudulent purpose.

You are solely responsible for ensuring that leads loaded into the system have provided appropriate consent to receive calls and text messages.

Section 06

Billing and Subscriptions

• Subscription plans are billed monthly via Stripe. A valid credit or debit card is required.
• Free trials require a card for verification; you will not be charged during the trial period.
• If you do not cancel before the trial ends, your selected plan will be charged automatically.
• You may cancel at any time through your Stripe billing portal.
• No refunds are provided for partial months.

Section 07

SMS and Messaging Consent

By subscribing to SMS notifications from CloseEngine AI, you consent to receive text messages related to our service. Message frequency may vary. Message and data rates may apply. Consent is not a condition of purchase.

• Reply STOP to opt out at any time.
• Reply HELP for assistance.

Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.

Section 08

Intellectual Property

All technology, branding, and proprietary systems powering CloseEngine AI remain the sole property of CloseEngine AI. You retain ownership of your lead data and CRM information.

Section 09

Limitation of Liability

CloseEngine AI is provided "as is" without warranties of any kind. We do not guarantee that our AI will book appointments or generate sales. We are not liable for any indirect, incidental, or consequential damages arising from use of the Service.

Our total liability shall not exceed the amount you paid for the Service in the preceding 30 days.

Section 10

Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any reason with reasonable notice. Upon termination, your lead data will be available for export for 30 days, after which it may be deleted.

Section 11

Changes to Terms

We reserve the right to update these Terms at any time. Changes will be communicated via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
